Yes, mediation is compulsory if you wish to ask the Court to make an order regarding finances, unless you are able to claim an exemption. In order to proceed to court for a financial application, you must show proof (in the absence of being able to claim an exemption) that you have attempted mediation by attending an initial Mediation Information and Assessment Meeting (MIAM). If mediation has been deemed unnecessary for your circumstances, then proof of this will also be required before legal proceedings can move forward.
If you seek mediation but your spouse does not consent, then you can still obtain proof that you have tried to initiate mediation and that it has been unsuccessful.

Mediation is legally required, unless your matter falls into one of the exemptions before a financial claim or an application regarding Children is made. It is still advisable, to seek legal advice regarding the discussions that occur during mediation sessions. It is often helpful to do this, as it means you can still come to a mutually beneficial agreement without the need for an application, while ensuring you know exactly where you stand legally with regards to the specific consequences of these agreements.
