Family Dispute Resolution

Disputes within families, particularly where significant assets and business interests are involved, require precision, discretion and the guidance of family dispute resolution experts.

At Goodwins – part of Collins & Hoy Solicitors – we work to understand our clients’ personal circumstances and financial position as family dispute resolution solicitors, helping to reach an amicable outcome.

Providing expert family mediation services to clients in Pinner, Harrow and across London, we are committed to helping clients navigate the complex with clarity through dispute resolution. In order to protect assets and avoid the delay, cost and exposure of court proceedings, we offer:

Types of Family Conflicts

Dispute resolution is not just for divorce settlements; many family conflicts can be navigated this way, with sensitivity and a focus on practical outcomes. This includes financial settlements, property structures and arrangements for children, inheritance disputes, pre-nuptial agreements and cohabitation disputes. We provide a constructive and forward-focused approach with resolutions reached by agreement of both parties.

We provide a structured approach, relevant legal information and guidance, with calm, clear dialogue. We work with you to guide you as to the best dispute resolution process for you and your circumstances, and to use that to secure agreements without court proceedings. Our extensive experience in family law and in dispute resolution is used to reduce conflict and cost. However, we are also happy to represent you in court through litigation if it becomes necessary.

Contact us today to discuss your requirements for dispute resolution, and our solicitors and mediators will be able to assess the most appropriate course forward with discretion and clarity.

The benefits of family dispute resolution

  • Reduced stress & tension
Choosing out-of-court proceedings relieves some of the emotional toll, resolving disputes without the daunting prospect of drawn-out litigation.
  • Preserving mutual respect
We believe dispute resolution offers the chance to maintain an amicable relationship and open communication. This is especially beneficial where children are involved.
  • Preserve assets & minimise costs
Court proceedings can quickly erode financial resources. Resolving disputes without costly litigation gives you greater control of your finances and assets for the future.
  • Expedited resolutions
Prioritise cooperation over confrontation to avoid elongated timelines and reach amicable resolutions with greater efficiency.

Considerations for Resolving Divorce Without Court Intervention

Do I need to go to court to finalise a divorce settlement?

No, many cases can be resolved without setting foot in a courtroom. This reduces costs, streamlines the process and protects your privacy.

What is Mediation?

It’s a confidential process where a neutral, trained mediator helps families reach practical agreements without taking sides.

Can Mediation provide a smoother process?

Yes. Our structured mediation gives an impartial forum to reach agreements on topics such as financial division and child arrangements.

What is Hybrid Mediation?

Our mediator solicitors will work with both parties and their solicitors, who can be present to support and advise. This is ideal for complex or high-conflict cases.

What is Collaborative Law?

This is when both parties and their lawyers agree to resolve the dispute using round table meetings and direct dialogue. Lawyers and parties agree not to issue court proceedings. Each client appoints their own specialist, collaboratively-trained lawyer to structure and plan together meetings to deal with financial settlements or child arrangement disputes. This process works well when negotiating pre- and post-nuptial agreements.

What is Resolution Together?

A specially trained, single solicitor will advise both parties jointly and transparently to facilitate discussions and negotiations to help reach agreements on financial settlement and child arrangement disputes. They also formalise these for submission to the courts. This is a cost-effective, co-operative way to resolve disputes where suitable.

What is Child Inclusive Mediation?

This process gives children a voice, allowing them to meet a specially trained mediator. With their consent, their views can be carefully considered by you, the parents, to make informed decisions concerning child arrangements.

What is Early Neutral Evaluation?

EVE provides impartial legal expertise, with an early assessment of the likely outcome if the case were to go to court. This allows both parties to understand their positions, encouraging each to make realistic, informed settlement decisions.

What is Arbitration?

This is a private, binding alternative to court. A qualified arbitrator will make decisions on financial or child-related issues that will be turned into a court order.
